Zwei Gutachterinnen haben im Herbst 2010 das für 2013 geplante Betreuungsgeld unter die Lupe genommen: Prof. Dr. Margarete Schuler-Harms für die Friedrich-Ebert-Stiftung und Prof. Dr. Ute Sacksofsky für Bündnis 90/Die Grünen. Sacksofsky, die der VAMV aus ihrer kritischen Beurteilung des Ehegattensplitting kennt, kommt zum eindeutigen Ergebnis, dass „die geplante Einführung eines Betreuungsgelds gegen den Schutz der Familie nach Art. 6 Abs. 1 GG und gegen den Verfassungsauftrag zur Förderung der tatsächlichen Durchsetzung der Gleichberechtigung von Frauen und Männern nach Art. 3 Abs. 2 Satz 2 GG“ verstößt. Insbesondere Sacksofskys Ausführungen in Bezug auf die von Familienministerin Schröder viel zitierte „Wahlfreiheit“ sind lesenswert, da sie es schafft, mit diesem Argument endgültig aufzuräumen. Sie stellt die Frage, „ob das Betreuungsgeld wirklich Wahlfreiheit vermittelt oder nur freie Wahl suggeriert.“ Indem der Staat die Familien mit einem Betreuungsgeld belohnt“, die ihre Kinder zu Hause betreuen und nicht in eine Kita geben, macht er diese Entscheidung attraktiver, da die andere Alternative bedeutet, auch noch Kinderbetreuungskosten an die Kita zu bezahlen. Als anschauliches Beispiel nennt Sacksofsky die Öffentliche Bücherei, die auch Gebühren für das Ausleihen von Büchern nimmt. Absurd ist hier der Gedanke, dass Menschen, die keine Bücher ausleihen, eine „Entschädigung“ oder „Belohnung“ dafür erhalten, dass sie die Öffentliche Bücherei nicht nutzen. Genauso wäre das beim Betreuungsgeld. Schuler-Harms prüft ebenfalls das geplante Betreuungsgeld und kommt zum Urteil „verfassungsrechtlich prekär“. Sie konstatiert eine einseitige Förderung des Staates zugunsten einer Familienform mit traditioneller Rollenaufteilung und nennt dies „Mehrfachprivilegierung konservativer Arbeitsteilung“, da auch das Ehegattensplitting und die kostenfreie Mitversicherung der Ehefrau in der Krankenversicherung ihres Ehegatten staatlich subventioniert werden. Gefördert werde die „Alleinernährerfamilie, die klassische Arbeitsteilung und zementiert auf diese Weise konservative Rollenmuster“.
Dies entspreche nicht dem Staatsziel der Herstellung von Gleichberechtigung von Mann und Frau. Die Verfassungsreform von 1994 in Bezug auf Art. 3 Abs. 2 Satz 2 GG lautet: „Der Staat fördert die tatsächliche Durchsetzung der Gleichberechtigung von Frauen und Männern und wirkt auf die Beseitigung bestehender Nachteile hin.“ Das aus vielen Verbänden bestehende Bündnis gegen die Einführung des Betreuungsgelds, dem auch der VAMV angehört, hat sich mit beiden Gutachten intensiv beschäftigt und wird die dort ausgeführten Argumente in die politische Diskussion einbringen.

Das Betreuungsgeld ist nicht nur völlig kontraproduktiv, was die Herstellung der Gleichberechtigung betrifft. Es ist auch ein Ärgernis, weil es einseitig ein konservatives Wählerklientel bedient und der Staat bereit ist, dasfür sehr viel Geld auszugeben, das er besser für die Bildung aller Kinder investieren sollte.
Zu Hause bei den Kindern bleiben muss man sich finanziell leisten können. Schon aus diesem Grund ist das Betreuungsgeld überflüssig. Oft wird das Betreuungsgeld auch mit der Anerkennung der Erziehungsleistung zu Hause gerechtfertigt. Und was ist mit all den Vätern und Müttern, die sich tagtäglich alleine dafür krummlegen, Kinder und Beruf unter einen Hut zu kriegen und die dafür vom Staat mit einer der höchsten Steuer- und Abgabenlasten in der EU (laut OECD-Vergleich) abgestraft werden und somit diesen Unsinn auch noch mitfinanzieren dürfen.
Kleine Anmerkung: In der Aufzählung der Privilegien der konservativen Arbeitsteilung fehlt noch die kostenlose Mitversicherung in der Deutschen Rentenversicherung.
